§ 1 Scope

These General Terms and Conditions apply to all orders placed through the online shop of Eugen Martens (Martèu).

§ 2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer. By clicking the "Buy Now" button, you place a binding order. Confirmation of receipt of your order will be sent by email. The purchase contract is concluded upon dispatch of the goods.

§ 3 Prices and Shipping Costs

All prices are final prices. As a small business owner in accordance with § 19 UStG, no sales tax is calculated or shown. Additional shipping costs incurred will be displayed during the ordering process.

§ 4 Payment

Payment is made using the payment methods offered in the shop. The invoice amount is due immediately.

§ 5 Delivery

Delivery time is generally 3–7 business days within Germany and 7–14 business days internationally, unless otherwise specified. We ship worldwide.

§ 6 Right of Withdrawal

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you took possession of the goods. The complete withdrawal policy can be found on our Withdrawal Policy page.

§ 7 Warranty

The statutory warranty rights apply. The warranty period is two years from the date of delivery of the goods.

§ 8 Limitation of Liability

Customer claims for damages are excluded unless otherwise specified for the reasons below. This also applies to the seller's representative and vicarious agents if the customer asserts claims for damages against them.

§ 9 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

§ 10 Dispute Resolution

The EU Commission provides a platform for out-of-court online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
